Afterwards, the human rights have become the common language of politicians and rulers in all kinds of governments. Islamic governments were no exception and were finally able to achieve the declaration of Islamic Human Rights in 1990. It must be acknowledged that the West, as the origin of human rights in its modern sense, has in no way been able to grasp the specific views of other societies, especially Islamic societies, which are not closely related to the provisions of the 1948 Declaration. In fact, human rights in the Islamic civilization is a critique of a way of thinking that introduces human rights as having only one version; A view that, as a formative law, presents a human being different from the understanding of all Muslims, and as a result of the rejection of the notion of human rights that Islamic legal systems are condemned for, non-observance of fundamental human rights is concluded. Now, regardless of the view of the Western world, Islam, as a civilization-building system, claims human rights that are the product of human nature and its connection with the elements of existence as creatures of Almighty God; This article, while taking an inward look at Islamic law, emphasizes that human rights can be abolished by the concept of citizenship rights and bound by cultural, geographical, and indigenous constraints, just as absolute and universal human rights can be constrained by religion, accepted without compromising the purpose of these rights. In the implementation phase, the Islamic government as a whole will be responsible for accepting and acknowledging the rights, and secondly, due to the order of precedence, a set of human rights derived from natural rights will be imposed on the government and the government is required to comply with its provisions. }, keywords = {human rights,Citizenship rights,Islam,Islamic Government,Natural rights,civilization}, title_fa = {مختصات حقوق بشر در تمدن نوین اسلامی و تعهدات حکومت اسلامی در قبال آن}, abstract_fa = {حقوق بشر به معنای امروزین خود در 1948 میلادی به وسیله اعلامیه جهانی حقوق بشر متولد شد و از آن پس حقوق بشر زبان مشترک غالب سیاستمداران و حاکمان در انواع حکومتها شد. دولتهای اسلامی نیز در این میان مستثنی نبوده و نهایتاً توانستند در 1990 میلادی به اعلامیه حقوق بشر اسلامی دست یابند. باید اذعان کرد که غرب به عنوان خاستگاه حقوق بشر در مفهوم نوین خود به هیچ وجه نتوانست نگاه خاص جوامع دیگر خصوصاً جوامع اسلامی را که با مفاد موجود در اعلامیه 1948 قرابت چندانی ندارد، دریابد. در واقع حقوق بشر در جریان تمدنساز اسلام منتقد طرز فکر و دیدگاهی است که حقوق بشر را تنها واجد یک نسخه معرفی می کند؛ دیدگاهی که به سان یک قانون تکوینی، انسانی متفاوت از مفاهمه تمامی مسلمانان ارائه میکند و در نتیجه عدم پذیرش این تلقی از حقوق بشر است که نظام های حقوقی اسلامی محکوم به عدم رعایت حقوق بنیادین بشری میشود. حال فارغ از نگاه دنیای غرب، اسلام به مثابه یک نظام تمدنساز، مدعی حقوق بشری است که زاییده طبیعت انسانی و ارتباط آن با عناصر هستی به عنوان مخلوقات خداوند قادر متعال است؛ در این مقاله ضمن نگاه درونگرا به شریعت اسلامی بر این نکته تأکید میشود که حقوق بشر میتواند توسط مفهوم حقوق شهروندی از اطلاق خارج شده و به قیودات فرهنگی، جغرافیایی و بومی مقید شود، به همین سان حقهای بشری مطلق و جهانشمول می تواند توسط دین قیوداتی را بپذیرد بدون آنکه به هدف و غایت مجموعه این حق ها خللی وارد آید. در مرحله اجرا نیز حکومت اسلامی در کلیت خود اولاً وظیفه پذیرش و به رسمیت شناختن حقها را بر عهده خواهد داشت و ثانیاً به دلیل تقدم رتبی، مجموعهی حقوق بشر منبعث از حقوق طبیعی، بر نهاد دولت نیز تحمیل میشود و دولت ملزم به رعایت مفاد آنست.}, keywords_fa = {حقوق بشر,حقوق شهروندی,اسلام,حکومت اسلامی,حقوق طبیعی,تمدن}, url = {https://nic.shahed.ac.ir/article_785.html}, eprint = {https://nic.shahed.ac.ir/article_785_fc2968eb0f3552ca62bd99a7b09ed1a3.pdf} }
